Offshore Turbine Supply Agreement

I. Construction agreements. The various agreements that must be concluded by a project promoter are decisive for the development of a wind project: C. Completion and start-up commitments. How wind turbines will be put into service, when and by whom they are to be put into service, should always be defined within the framework of the provisions of the labour agreement. Currently, the turbine supplier is almost without exception responsible for the commissioning of the wind turbines it supplies. As a result, the sequence of events for a typical North American project is as follows. The turbine supplier supplies the turbine generators to the site and then becomes the responsibility of the contractor. The contractor then builds and manufactures the facilities « fully » and then hands the devices over to the turbine supplier. Once a device is mechanically complete and return power is available, the turbine supplier puts each unit into service and prepares it to generate electricity in the grid. Typically, the turbine manufacturer also builds the turbine for projects outside of Canada and the United States, removing the interface with the facility builder`s balance. These interfaces are important steps in the development of the project, and if one party fulfills its obligations in a timely manner, it will have implications for maturities and costs for other parties. As a result, the details of when and how these interfaces are created and determined become very important.

When these progress bricks are reached, completion is usually demonstrated by certifications. B « delivery » (to be filled by the turbine supplier), « mechanical completion of the turbines » (to be filled by the contractor) or « commissioning fencing » (to be filled by the turbine supplier). Any certification of this type is considered an incremental step that each wind turbine generator must complete to reach the next step. Once all the milestones are completed, the project will be substantially completed. If the essential completion is not reached on a date agreed by the parties, the rest of the facility builder may be suspended. Given this participation and in order to avoid problems arising from potential inconsistencies, the project proponent should be willing to present lenders and investors with a consistent and convincing set of project agreements and listen to their proposals for these agreements.
